Terms & Conditions

The following terms and conditions apply to the MAC Cosmetics TikTok Creator Program with Vinelab FZ-LLC (hereafter referred to as “Sociata”). Please take the time to read these carefully, as they are written to protect mutual interests. The relationship between Sociata and MAC Cosmetics and yourself as the creator are bound by these Terms and Conditions, herein set out, upon agreeing to them on the form.

1. Creator shall hold strictly confidential, all information and material provided by Sociata and shall not use or disclose the Confidential Information unless expressly authorized to do so in writing by Sociata.

2. Creator confirms that he/she procured all the necessary licenses to execute this agreement including a content creator license if required by the local authorities.

3. You are being given a MAC Cosmetics gift box for your personal use and the gift box cannot be sold, traded or put into any commercial use by yourself or any of your affiliates.

4. Creator is obligated to create a social media video (Content) on TikTok showcasing the use of the product. Content must be accurate where stating facts, genuinely held where stating opinions, fair and legal. 

5. Content needs to be approved by MAC Cosmetics prior to publishing. Sociata is responsible for getting the required approvals.

6. The Creator will be provided with a special TikTok link to upload the video. This enables MAC Cosmetics and Sociata to evaluate the Creator to receive larger and further benefits in the program, which may lead to direct financial incentives and other benefits.

7. MAC Cosmetics cannot republish the content without prior consent from the Creator. Content is under the sole ownership of the Creator.

8. MAC Cosmetics is allowed to boost the content on the Creator account in order to promote the Creator and the Content using Spark Ads.

9. The Creator is required to be responsive at all times during the stages to ensure successful completion.

10. In the event the Creator decided to publish content, the said content must not: 

a. include any content that is slanderous, indecent, aggressive, hurtful, or provocative, or that encourages explicit sexual content, brutality, or prejudice based on ethnicity, gender, faith, nationality, disability, sexual preference, or age;

b. violate any other individual's copyright, trademark, or additional intellectual property rights;

c. have the potential to mislead anyone or be created in violation of any lawful obligation to a third party, such as a contractual responsibility or a duty of confidentiality;

d. appear menacing, hostile, or likely to bother or humiliate another person, or intrude upon someone's personal space;

e. be employed to feign being someone else, or to misrepresent your identity or connection to any individual;

f. create the impression that they originate from us, if that is not accurate; and

g. endorse, encourage, or facilitate any illegal activity.

11. Creator cannot claim to be in partnership with MAC Cosmetics or Sociata. Creator agrees that no material cash or money transfer payment was made to her in return for this collaboration.

12. Sociata takes the private nature of your personal information very seriously. We store the information you explicitly provide to us in a highly secured private database. The usage of this information is strictly related to fulfilling our work in sending you the gift along with the communication necessary to fulfill our commitment. 

تنطبق الشروط والأحكام التالية على برنامج MAC Cosmetics TikTok Creator Program with Vinelab FZ-LLC (المشار إليها فيما بعد باسم "Sociata"). يرجى قراءة هذه الشروط والأحكام بعناية، حيث إنها مكتوبة لحماية المصالح المتبادلة. يرتبط العلاقة بين Sociata و MAC Cosmetics وأنت كمبدع بموجب هذه الشروط والأحكام، التي يتم تعيينها فيما يلي عند الموافقة عليها في النموذج

1. يجب على المبدع الحفاظ على سرية جميع المعلومات والمواد التي يتم تزويده بها من قبل Sociata وعدم استخدامها أو الكشف عن المعلومات السرية إلا بموجب إذن خطي من Sociata.

2. يؤكد المبدع أنه قام بالحصول على جميع التراخيص اللازمة لتنفيذ هذه الاتفاقية، بما في ذلك ترخيص مبدع المحتوى، إذا لزم الأمر من قبل السلطات المحلية.

3. يتم تقديم صندوق هدايا MAC Cosmetics للاستخدام الشخصي ولا يمكن بيعه أو تداوله أو استخدامه في أي عمل تجاري من قبل المبدع أو أي من شركائه التابعين.

4. يلتزم المبدع بإنشاء فيديو على وسائل التواصل الاجتماعي (المحتوى) على TikTok يعرض استخدام المنتج. يجب أن يكون المحتوى دقيقًا عند الإعلان عن الحقائق، وحقيقي عند الإعلان عن الآراء، وعادلًا وقانونيًا.

5. يجب الموافقة على المحتوى من قبل MAC Cosmetics قبل النشر. تتحمل Sociata مسؤولية الحصول على الموافقات اللازمة.

6.  سيتم تزويد المبدع برابط خاص على تطبيق TikTok لتحميل الفيديو، مما يتيح هذا لـ MAC Cosmetics و Sociata بتقييم المبدع للحصول على مزايا أكبر وأكثر في البرنامج ، مما قد يؤدي إلى حوافز مالية مباشرة ومزايا أخرى.

7. لا يحق لـ MAC Cosmetics إعادة نشر المحتوى بدون موافقة مسبقة من المبدع. المحتوى ملك المبدع حصريًا.

8. المحتوى تحت ملكية المبدع وحده.

9. يحق لMAC Cosmetics  بتعزيز المحتوى على حساب المبدع من أجل الترويج للمبدع والمحتوى باستخدام Spark Ads.

10. يجب على المبدع  أن يكون متجاوبًا في جميع الأوقات خلال المراحل لضمان إكمالها بنجاح.11. في حال قرر المبدع نشر المحتوى، يجب ألا يكون المحتوى المذكور:

A) يتضمن أي محتوى تشهيري أو غير لائق أو عدواني أو مؤذٍ أو استفزازي أو يشجع على المحتوى الجنسي أو الوحشية أو التحيز على أساس العرق أو الجنس أو المعتقد أو الجنسية أو الإعاقة أو التفضيل الجنسي أو العمر

B) ينتهك حقوق الطبع والنشر أو العلامة التجارية أو حقوق الملكية الفكرية لأي فرد آخر

C) لديه القدرة على تضليل أي شخص أو يتم انشاؤه بشكل ينتهك أي التزام قانوني تجاه طرف ثالث، مثل المسؤولية التعاقدية أو واجب السرية

D) يظهر بشكل يدل على التهديد، أو العدائية، أو من المحتمل أن يزعج أو يهين شخصًا آخر، أو يتطفل على المساحة الشخصية لشخص ما

E) يوظف للتظاهر بكونك شخصًا آخر، أو لتحريف هويتك أو صلتك بأي فرد

F) يخلق الانطباع بأن مصدره العلامة التجارية وهذا ليس دقيقًا.

G) يؤيد أو يشجع أو يسهل أي نشاط غير قانوني.

12. لا يمكن للمبدع الادعاء بأنه شريك لـ MAC Cosmetics أو Sociata. يقرّ المبدع أنه لم يتلقَ أي مبلغ نقدي أو نقل مالي له كتعويض عن هذا التعاون.

13. تأخذ شركة Sociata المعلومات الشخصية الخاصة بك بجدية تامة. نحن نخزن المعلومات التي تقدمها لنا بشكل صريح في قاعدة بيانات خاصة محمية بشكل كبير. نستخدم هذه المعلومات حصرياً لتنفيذ عملنا في إرسال الهدية مع الاتصالات اللازمة لتحقيق التزامنا.
